Redistricting authority:
U.S. Congressional Districts – Legislative see below.
State Legislative Districts – Legislative. In the past, the executive board of the legislative
council formed a special redistricting committee to report a committee bill on legislative
redistricting (S.D. has only 1 congressional seat, so no current need to redistrict). There is
nothing in statute that creates this council. If the Legislature fails to reach a plan that is approved by the Governor by December 1, 2011, redistricting falls to the S.D. Supreme Court, who has 90 days to formulate a plan.
